
Collaborative Prenuptial and Postnuptial Agreements
On average, couples spend between 12 and 18 months planning their wedding. Approximately 40% of first marriages end in divorce. The divorce rage is larger as parties enter their second or third marriage. Although it is difficult to have conversations about divorce, the true value of a prenuptial agreement is that it allows the couple to gain an understanding of the law as it relates to divorce and provide an opportunity for them to craft their own agreement as it relates to their unique financial situation. These transparent conversations can help the couple create a solid foundation as they begin their marriage.
Utilizing the Collaborative process to help couples craft well-structured prenuptial or postnuptial agreements is one of the highlights of the work that I do. In this process, each couple selects a Collaborative attorney. The four of us work together to understand the goals of each party and create an agreement that aligns with the couple’s goals. This process promotes cooperation in the creation of the agreement as each party has time to discuss their needs and also hear the needs of their future spouse. Choosing the Collaborative approach removes the adversarial nature of the process and allows parties to come to an agreement.
